Cashabroad México, S.A. de C.V. (hereinafter,”Cashabroad“), with address at C. Río Lerma 94, Cuauhtémoc, 06500 Mexico City, CDMX, is aware of the importance of the protection of personal information and personal data (hereinafter”Personal Data”) and those sensitive personal data that affect the owner's most intimate sphere, or whose misuse may give rise to discrimination or pose a serious risk to the owner (hereinafter”Sensitive Personal Data”), has for our Customers. In order to inform how Personal Data and Sensitive Personal Data will be collected, stored and processed by Cashabroad, this Privacy Notice has been prepared (hereinafter”Notice”).
Capitalized terms whose meaning is not expressly included in this Privacy Notice will have the meaning given to them in the Cashabroad Terms and Conditions that are available for consultation at www.cashabroad.one/terms and conditions (the”Terms and Conditions”).
This Privacy Notice establishes the guidelines that Cashabroad follows in the processing of your Personal Data and Sensitive Personal Data as a customer of the platform available through our Platform (hereinafter”Platform”), and in the use of our website available through www.cashabroad.one/privacy notice.
For the provision of the Services, we will need to carry out the processing of your Personal Data and Sensitive Personal Data; therefore, prior to their use, we provide you with our Privacy Notice, which is an integral part of the Terms and Conditions.
When using our Platform, you grant your consent for Cashabroad to lawfully collect, use, process and protect your Personal Data and Sensitive Personal Data for the purposes set out below. You must confirm that you have read this document and are satisfied with the terms of this document.
The purpose of this Notice is to explain to you:
Our Platform is not intended for minors. Cashabroad only processes Personal Data from people over 18 years of age, with full legal capacity to be bound, as well as to provide their informed and free consent. If you believe that Cashabroad may have collected information from a minor under your guardianship without your authorization, please contact us at avisodeprivacidad@cashabroad.one, and we will delete that information in accordance with the secure procedures we have established.
Cashabroad collects your Personal Data and Sensitive Personal Data under different circumstances, such as: (a) when using our platform or visiting our website; (b) when you communicate directly with us; (c) when interacting with our Services; (d) when entering into a contract to use our Services; and (and) by providing us with instructions related to your Cashabroad account.
The processing of your Personal Data and Sensitive Personal Data is based on your prior, free, and explicit consent, or on the Federal Law for the Protection of Personal Data Held by Individuals when applicable. By expressly consenting in writing to this Privacy Notice, you accept the use of your Personal Data and Sensitive Personal Data for the purposes expressly indicated in this document. Cashabroad will provide free and appropriate mechanisms for you to express your consent once you have read this Privacy Notice.
Cashabroad is responsible for the processing of Personal Data and Sensitive Personal Data. We will not share your Personal Data or Sensitive Personal Data with third parties, except those indicated in the section Who we might share your Personal Data with or if we have your express written authorization, as required, to do so, or we must do so in compliance with a legal obligation, or when required by law. Personal Data and Sensitive Personal Data may be stored on servers located outside your country of origin, under protection measures in accordance with legal and industry standards.
We do not sell or disclose to third parties the Personal Data or Sensitive Personal Data that we collect from Customers.
The categories of personal data that Cashabroad collects, processes and protects to carry out the purposes described in this Privacy Notice, include:
Cashabroad may also collect and process biometric data, considered as Sensitive Personal Data, for identity verification when using our Services. If applicable, we will inform you about the Services that require the use of biometric data.
Cashabroad only collects your Personal Data and Sensitive Personal Data if you provide them to us voluntarily. This can happen during your registration with Cashabroad, by phone call, email or instant messaging through our customer service.
We may also obtain information from publicly available documentary or commercial sources, indirectly and from sources permitted by law, as well as in cases where such information is provided to us by another person authorized to do so.
We use your Personal Data and Sensitive Personal Data for the following primary purposes, which are necessary for the provision of the Services:

If you do not want Cashabroad to use your Personal Data for these secondary purposes, you can notify us at the email address arco@cashabroad.one. The refusal will not affect the provision of our Services.
In addition to the above, we inform you that you can limit the use and disclosure of your Personal Data by registering in the Public Registry to Avoid Advertising by the Federal Consumer Attorney's Office (hereinafter”PROPHECY”).
We may share your Personal Data with:

(ii) Third parties for whom you have given us your prior, express and written consent, or for whom there is an authorization or legal obligation to do so without that consent, or that the transfer is necessary for the maintenance or compliance of the legal relationship we have with you.
As the owner of Personal Data and Sensitive Personal Data, you have the right to access your personal data, to rectify your personal data when they are inaccurate or incomplete; to cancel your personal data, as well as to object to their processing (hereinafter”ARCO Rights”).
You can exercise your ARCO Rights by submitting a written Request for ARCO Rights to the email address arco@cashabroad.one. In any case, the ARCO Request for Rights must contain the following: (a) name of the owner and address or means to communicate the respective answer to you; (b) documents that prove your identity, or, where appropriate, that of your legal representative; (c) a clear and precise description of the personal data with respect to which you are seeking to exercise any of the ARCO Rights; in the case of requests to rectify Personal Data, you must also indicate the modifications to be made; and (d) documents or elements that facilitate the location of the respective Personal Data.
Cashabroad will process requests that meet these requirements. If you do not meet the above requirements, Cashabroad will consider that you have not submitted your request, stating this within a maximum period of 5 (five) business days from the date the request was received, by email sent to the address indicated in the request itself, which will indicate the omissions that have been incurred. However, the above, your rights to submit a new request to exercise your ARCO rights will be protected.
Cashabroad will communicate the determination adopted within 20 (twenty) days from the date on which the ARCO Request for Rights was received, so that such determination becomes effective within 15 (fifteen) days following the date of communication of the response to the respective ARCO Request for Rights.
You can also revoke the consent granted to Cashabroad for the processing of your Personal Data. In this regard, it is important to note that not in all cases your request can be answered or the processing completed immediately, since there may be legal obligations for Cashabroad, as a result of which it requires continuing the processing of your Personal Data.
To revoke your consent, you must submit a Request for Revocation of Consent to the email address arco@cashabroad.one. Cashabroad will process your Request for Revocation of Consent provided that the request contains the following: (a) name of the owner and address or means to communicate the respective answer to you; (b) documents that prove your identity, or, where appropriate, that of your legal representative; and (c) clear and precise description of the Personal Data for which you revoke your consent. The deadlines for responding to Requests for Revocation of Consent will be the same as those provided for the exercise of ARCO Rights.
Cashabroad has implemented security measures to protect your Personal Data and Sensitive Personal Data against loss, theft, misuse, and alteration.
We inform you that our Platform may contain hyperlinks “links” and/or “banners” that redirect to third-party websites. Cashabroad will not be responsible for the Personal Data and information you provide through Internet pages. Cashabroad recommends that its Customers check the privacy notices of third-party websites before providing any type of information.
We inform you that on our website we can use cookies, web beacons and other technologies to improve your experience and offer you personalized Services. You can deactivate cookies and adjust your browser settings to be notified before storing cookies. However, if you disable these technologies, some features of the website may not work properly or may not be available.
Cashabroad may modify the Privacy Notice at any time, as a result of new legal requirements, specific needs of the Services, changes in its privacy practices or variations in its business model. When that happens, we will notify you by email and, if necessary in accordance with the Federal Law on the Protection of Personal Data Held by Individuals, we will request a new authorization and consent.
At Cashabroad, we keep your Personal Data and Sensitive Personal Data only for as long as necessary to fulfill the purposes for which we process such information. The length of time the records are kept is determined based on the type of record, its nature and the applicable legal obligations. In general, Personal Data and Sensitive Personal Data collected to comply with our legal obligations, such as in the case of the prevention of money laundering and terrorist financing, are kept for the entire duration of the relationship with Cashabroad, and after that, for a period not less than 5 (five) years.
However, in certain cases we may keep your Personal Data and Sensitive Personal Data for longer periods when necessary to comply with a legal obligation to which we are subject, or when required to do so by a competent administrative or judicial authority.
If you consider that your right to the protection of your Personal Data has been injured by any conduct or omission on the part of Cashabroad, or you presume a violation of the provisions of the Federal Law on the Protection of Personal Data Held by Individuals, you can file your disagreement or complaint with the National Institute for Transparency, Access to Information and Protection of Personal Data (hereinafter”INAI“). In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Individuals, you and Cashabroad agree that, for the purposes of this Privacy Notice, you may express your consent electronically, having the same effects that Mexican legislation grants to autograph signatures, in terms of Title Two, of the Second Book of the Commercial Code.
